– Press release from the Mono County Sheriff’s Office:
The Mono County Narcotics Enforcement Team (MONET), along with the assistance of Mono County Sheriff Deputies and the Mammoth Lakes Fire Department, concluded a warrant investigation in the Town of Mammoth Lakes.
On the morning of Wednesday, July 10, 2013, Jacob Pellegrini, age 29, of Mammoth Lakes, CA, was arrested for sales and possession for sales, cultivation, and chemical production of concentrated cannabis.
Mr. Pellegrini was operating a full marijuana lab in his place of residence where 98 plants and 5 grams of “wax” (marijuana hash manufactured via butane) were seized. Mr. Pellegrini was taken into custody by Mono County Sheriff Deputies and transported to the Mono County Jail in Bridgeport without incident.
Mr. Pellegrini is currently in custody with charges pending through the Mono County District Attorney’s Office.

Hey,”Had To Comment”……If you read my post “before” you comment,you’d see I said some “THINK” if you had a med card,it’s a get-out-of-jail-free pass…NOT saying Law Enforcement will give it to you….That IS how a lot of cronic pot -heads think,and how some post here whenever someone is arrested for possession or driving under the influence….”if” you have a med card,you can “legally” drive stoned if you have a med card….or can legally go to a job high and an employer can’t do anything about it…..you can walk down the street smoking a joint ..one time,someone even stated if you have a med card,you can actually smoke a joint in an establishment that doesn’t allow smoking cigarettes !!…saying the “law allows” one to take their “medicine” no matter where they do it.I KNOW LE doesn’t allow people to drive while stoned….at my job,an EX-employee thought he could,found out he couldn’t the hard way (a DUI),lost his job because of it,and then talked of suing the County for arresting him….and then suing my employer for fireing him…..
Yeah a lot of misconceptions and crappy advise from people out there Wayne. A med card only allows you to possess it in the amount as prescribed. Everything else still applies, it’s still under the influence … behind the wheel .. etc … unless you’re in your house and not doing anything to attract the attention of cops.
Big Al……Don’t know which one of the “misconceptions” I got a kick out of more….The ex-employee at my job thinking my boss couldn’t do nothing about him getting high before going to work,during work,and then thinking he couldn’t get a DUI while driving stoned after work,and then losing his job for doing it……or the person that posted that the Law allows anyone with a med. card to take his “medicine” in dwellings that doesn’t allow smoking cigarettes…..like taverns,restaurants,markets, schools,etc.If my memory serves me right,I remember them stating “it’s no different than if you decide to take a tylonal or aspirin if you happen to have a headache.”…Thing is,these “misconceptions” and the people saying them,it’s just ANOTHER way for them to push the buttons because of their “medical conditions”,and thinking it’s their “right” to do as they please with that pot prescription in their wallet…but what it does is give a bad name to those that have serious illnesses’ that actually benefit from marijuana….and what passing that prop was all about.
It’s interesting how one can instantly tell those who have smoked the weed and those who never have.
All things considered, I think it would be no problem to follow the states that have already legalized the weed.

The honest people already have to put up with it? Why can’t we bypass these feelings of getting rid of the people who use drugs off the face of the planet (throwing them in jail) when we know that rarely works for anybody, being thrown in jail usually has adverse effects. If we were to look at the addiction problems has a human health issue rather then a crime we might have better results..
We have a serious problem and this fear of legalizing anything will turn everybody into users is foolish! I mean it’s not laws and regulations that make honest good people! For the record I’m not for legalizing the serious stuff that has no other benefit other then decaying the human body faster.

Okay Tourbillon, Global Warming or Climate Change? But okay you have a point. When I comment on something like climate change and have experts to support how I feel about the outcome of our daily lives,I jump all over it, I’m no expert and my views are still forming to this day. I know we can’t keep up this rate of cyclical consumption and this status quo of how we get our energy to fuel this “entitled” convenient life. The wasting of resources and the adverse effects some things are having on social aspects is something I well probably forevermore reinforce with credible info..

Many of your neighbors are drug abusers. Humans – by nature – are drug abusers. I bet you’re even great friends with some drug abusers and you don’t even realize it. Substance abuse is ubiquitous.

I agree. There are millions of honest, hard working people who smoke it regularly. What does putting them in jail solve? We tried locking them all up but we just can’t. There are more than 3/4 of a million people arrested every year for possessing a plant. This hasn’t curbed it’s use but it ruins the lives of people who otherwise lived honest, productive lives previously. Though, from others comments, some people don’t care about them because to you they are just “dregs”. What about the millions of tax payer dollars that are spent on housing them in the privatized prison system. Does anyone believe they are actually “reformed” and will come out and live a more productive life now that they have a criminal record. Can’t we learn anything from alcohol prohibition? The biggest proponents for keeping it illegal are those whose funding and profits come from the investigations and arrests of these people. Mainly, some law enforcement and specifically the DEA and the prison lobby. Not to mention we are funding organized crime. Another lesson we should have learned from alcohol prohibition. Why are we even debating if someone should be allowed to grow and consume a plant? If you want to make a plant illegal, why don’t we eradicate poison oak?

J Frog…I probably should have stated it different…..When I voted “yes” on the prop back a few years ago,I figured it was a good thing to help those with serious medical issues that people claimed marijuana made it easier to deal with for them…what it was meant for.But who knew those with the “serious medical issues” would include everything from sore knuckles to ingrown toenails? One person I knew got a med card claiming marijuana helped his asthma….another stating it helped him with anger issues.Another,headaches he laughed about not even having.And,in most cases,it’s not the “problems” of having to buy off the streets,it’s more seen by some as a legal way to grow and sell to anyone that wants to buy….and thinking if your driving and in possession and high as a kite,Law Enforcement will see the med card and choose not to deal with it. And I’ve known of people with med cards that either don’t grow or are waiting on harvest, that do buy from the pot shops,and then turn it and sell it making a HUGE profit,knowing if someone is out and wants to buy,price is of little importance to them,and easier for them than to drive 100+ miles to a pot store…kinda using the “buy local” theory I guess…This story proves my point….wouldn’t be too suprising if this guy with the beard HAS a med card….obvious he’s(allegedly) selling,but with that med card,and a pot doctor to back him up, and some defense lawyer,a good chance he’ll be walking with no charges or prosecution…..

I have heard it from the some individuals (with the minor reasons of medicinal need) that have a pot card that they vote no on the legalize theme since it would cut into their clientele sells and profits. So yeah it is definitely flawed but the fact OUR government acts like it serving US by combating something that is so harmless with so much hidden benefits, it makes me sick.
And then we look at the stats of race who gets arrested and prosecuted, its a unfair imbalance of minority’s when we all know every race uses drugs pretty much the same per capita, it’s like a small form of jim crow laws if you can convict minority’s of felony drug charges you keep them from voting. I have mentioned it before the first drug law was against opium, but when the gov’t found out middle age white woman where the main user’s of opium they changed the law to “smoking opium” which targeted the Chinese railroad worker which was the initial target anyway. Drug laws have always been racist…
Look at the regions that legalized and the rates that went down, For example Portugal, there’s over ten years of stats since they have changed their approach.
Our Environment, or Republic/Democracy, and I feel our very own existence is counting on us to do something about integrating more sustainable practices into our daily lives.

I’m sure any of the local law enforcement would disagree with you. They will arrest you if your high on anything while driving. There are examples right on this site of people being arrested that had a medical card while driving. Some of them may not want to hassle someone who simply has some in his possession. Maybe because that’s the law. But they will NOT let someone high as a kite continue driving just because they have a medical card. That’s a DUI/DWI and the med. card is not a get out of jail free card.
And it does help people with serious med problems. Don’t let your perceptions of how it’s being abused overshadow the people it has and continues to help with medical problems. I only wish it had passed earlier so it could have helped one of my family members who lost a lengthy and painful battle with cancer. He couldn’t afford Marinol and didn’t want any legal problems. I hope you never have to watch someone suffer like that just because they can’t afford a perscription, while they are dieing.

The pot doc in mammoth writes recommendations to legally grow 99 plants. I would like to know if this 99 plant permit is truely legal?
Making wax hash isn’t illegal regardless of the danger if the guy had a pot card.

If a guy only grows once a year 99 plants isn’t necessarily out of line. If he’s growing 99 plants indoors and getting four crops a year I’d bet he’s selling. it’s pretty hard to grow pot outdoors above 7k due to the early freeze.

The state ruled plant limits unconstitutional, and making wax is illegal using a solvent extract such as butane. Do some research before sharing your uneducated opinions. Prohibition is such a waste of life, money, and time. Its just pot, people are way more dangerous on alcohol, why don’t they go round up the drunks instead.

What is wax?
Cannabis Concentrates 101
When humans learned that the Cannabis plant’s sticky resin glands contain the highest concentrations of active ingredients, the first cannabis concentrate was made and it was called hashish. Most hashish manufacturing techniques remain primative, like sieving through mesh nets or thrashing dried plants and collecting what falls off. Modern innovations using alcohol, chloroform, butane and other solvents to chemically extract cannabinoids are often called hash, but they are not hashish in the traditional sense of the word. These are termed “cannabis concentrates.” Many medical cannabis patients find the cannabis concentrates to be more effective medicine, as smoking or vaporizing lower-potency cannabis can be impractical and ineffective for them.
Solvent-manufactured cannabis concentrates have been available since the 1960′s as “honey oil,” “red oil,” “jelly-butane hash,” and similar concoctions. Cannabis concentrates are widely available and rapidly gaining popularity amongst medical cannabis patients. Delivering a concentrated dose of active ingredients without combusting or smoking the buds or”flowers” of the plant material is a big plus. The cannabinoid percentage and purity of solvent-extracted products is almost always higher than that of traditional hashish or any other readily available cannabis product on the market. However, many solvent extracted products are contaminated with solvent residues. With many how-to videos on the internet and simple materials purchased at the hardware store many patients are performing their own solvent extractions at home.
One of the more populpar cannabis concentrates being sold in the collectives and being made at home is Butane Honey Oil or BHO. This waxy concentrated cannabis extract is made by pushing liquid butane through a tube packed with cannabis plant material. Liquid butane quickly dissolves the trichome heads, and extracts the medicinal cannabinoid compounds. A solution of cannabinoids, waxes, and oils dissolved in butane comes out the other end through a filter. The cannabis/butane solution is collected and then evaporated in various ways to dissipate the butane solvent. Post extraction treatments include activated carbon filtration, alcohol washings, vacuum purging, heating and whipping in an attempt to rid the final product of solvent residue to obtain a pure product. Depending on the many variables of preparation and post treatment, BHO takes on many different textures, and therefore BHO goes by many names including the ever popular “WAX”.
One Wax hit is said to deliver two joints worth of cannabinoids all at once, and it’s less detrimental to the lungs more similar to vaporization. Wax is a bit more of a solid than an oil, it is simply BHO processed further and some prefer its ease of use and stronger potency. BHO in its more liquid forms can be spread on a rolling paper and in it’s more solid forms can be spread over a smoked form of cannabis to increase potency. Smoking “flowers” does not achieve the same relief for many patients, and they often require to smoke hourly whereas one concentrate hit may sustain an individual for many hours. Cannabis concentrates are more potent than any other cannabis product and may help with harm reduction from smoking over time.
Most concentrate conoseurs and health conscious individuals prefer to inhale the concentrate directly. Cannabis concentrates have created a whole new sub-genre of paraphernalia and terminology amongst cannabis users. A special bong like apparatus or bong attatchment is used and the concentrate vapor is generally filtered through water. One must heat a “nail” (made of glass or titanium) with a “torch” (similar to that used in the kitchen for crème brûlée) and when glowing hot – place a “dab” of concentrate on the “nail” with a “dabber” (metal or glass wand) immediately turning the concentrate to a vapor retained by the “bell” (a glass dome to keep the vapor from escaping) which is simultainiously inhaled. There is a bit of a learning curve, some rules of operation (basic pyrotechnics!) and proper ettiquette is required.
There are concerns around the cannabis concentrates, however. Firstly, the purity of the concentrate products. Traces of solvents in the final product can cause negative health effects. Effects of inhalation commonly observed with butane are blurred vision and incoherent speech, coughing, nausea and vomiting, and an increase in salivation. With higher exposure people can experience confusion, hallucinations, and aggressive behavioural patterns. Tinnitus, a ringing noise in the ears and a problem with muscle movements are also some of the side effects of butane. Many of these effects are seen with inferior quality butanes that have odor compounds added as butane itself is odorless. Only high quality premium refined butanes should be used to reduce toxicity. Celebrity talk show host Montel Williams has been public about his use of BHO that seemed to make his neurological symptoms worse from butane contamination.
Second concern is that of testing. There are no industry standards for routine testing of end products. Testing is available. A mass producer selling to the public should be routinely testing their product and labeling it. For the home extractor, testing your methods periodicly to make sure you are producing a clean product is important. There are devices that are available (such as the Tumesium) for solvent extractions that are virtualy a lab set up for home use. These units are apparently very efficient, reclaiming the solvent and filtering for future use, and properly purging the final product of solvent residue leading to a higher quality product. It is also much safer for the user. Butane is highly explosive, heavier than air tending to pool with inadequate ventilation, and is just waiting for a spark. Too many careless or inexperienced individuals have been maimed and killed in the making of BHO.
Fourth concern is that of legality. California has passed a solvent extraction law prohibiting the production of cannabis concentrates that were made by any chemical solvent, only exception being Water hash because water is not commonly know as a chemical. The penalty carries up to 7 years jail time and up to $50,000 in fines. Narcotics Task Force Commander Carl Sturdy says, “It’s the same punishment as making methamphetamine. BHO is also mostly devoid of terpene compounds (the odor compounds) which have been shown to work together with the cannabinoids for medicinal effects. In shifting the paradigm away from the “smoking of pot” to the use of cannabis as medicine, we do not want to give the opposition to medical cannabis more amunition. BHO truly is more potent and pschoactive, looks like opium (more like a processed drug than a plant), uses a crack torch, and can explode like a meth lab! Proper safety and common sense during production, achieving a quality solvent free end product, and proving it through appropriate testing should be the goal.

What to Do….I know of people with a med card that “grow it” and “sell it”…to whoever happens to want it,because of the safety-net of the med card….never asked them,but my bet is they don’t report their profits to the IRS when April 15th rolls around.The only way your theory would work is if weed was able to be bought in quick-stops and stores…..which ain’t NEVER gonna happen.Could you imagine the “dumbing-down” of society if it ever did ?

If someone wants to grow and posses marijuana under their physicians recommendation just to sell on the Black Market there should be a punishment by law in place, but that’s a flaw in the system and a risk people will make because anything that is illegal has a Black Market and there’s money to be made with risk.
FACT: Growers who do provide a cannabis club like Green Mammoth must fill out a W9, and we 1099 them on the income they received, and come the years end we mail out a W2 like any other employer.
If we don’t 1099 them then we can’t deduct the cost of goods or (CoG) and if can’t write off the CoG, then all our income would be a profit, and thats not good, California law states any cannabis club must operate as a non-profit.
With that being said I need to tell you how detrimental federal Tax Code Section 280E is for legitimate medical marijuana providers. Quite possibly the most serious problem for cannabis business, 280E forces state-legal industry operators to pay an effective tax rate two-to-three times higher than essentially all other U.S. businesses.
The table below shows an example of how 280E negatively impacted the 2012 tax burden of a real medical marijuana dispensary*. This business generated just over $500,000 in gross revenue and because of 280E, paid an effective tax rate of 93% instead of the average 15-35%.
