In Bridgeport on November 20, Superior Court Judge Edward Forstenzer presided over the preliminary hearing in the case against defendants Anthony Saucedo and Kevin Malburg,both 21 and from Mammoth Lakes, who have both been charged with assault with a deadly weapon during an attack with a skateboard on Mammoth resident Darrell Johnson. Saucedo also faces hate crime allegations.

DA Booth is seeking to prosecute Saucedo for assault with a deadly weapon with an enhancement for great bodily injury, as well as an enhancement for a hate crime. Witness testimony at Tuesdays hearing established that at least one of Johnson’s assailants was repeating racial slurs during the attack.

Booth is also seeking prosecution of a second assault with a deadly weapon charge against Saucedo, who allegedly struck another man with his skateboard that night.

Kevin Malburg faces charges of assault with a deadly weapon with an enhancement for great bodily injury.

Following witness testimony, Judge Forstenzer ruled that there was sufficient evidence to bring all counts to trial for both defendants.
