The Rossy settlement conference has been postponed, again. The conference will now take place Friday, March 20 before Judge Phillip Argento.
Kenneth and Dawndee Rossy and her attorney David Evans appeared in the Bishop Courthouse Thursday afternoon. Absent was Kenneth Rossy’s attorney, Gerard Harvey. Harvey was suspended beginning Nov. 21, 2014 and is ineligible to practice law for 90 days.
Inyo County District Attorney Tom Hardy had anticipated calling for a trial date if no settlement or movement toward a settlement occurred Thursday. While expressing his frustration with the delays following the brief proceedings, Hardy said he would rather not be faced with a re-trial on appeal for what he described as a long and complex case.
One possibility is another delay if Kenneth Rossy requests a court-appointed attorney. A previous October 6, 2014 trial date was vacated when Dawndee Rossy requested a court-appointed defense attorney after her private counsel, Michael Berger, was granted a motion to be released from the case.
The Rossys are facing 135 counts. The primary charge is embezzlement of $1.5 million from the Inyo County Department of Health and Human Services. The Rossy’s were arrested in April 2013, pleaded not guilty to the original 44 counts and have been out on bail since April 17, 2013.

I am always curious when I see my name in a local news story, sordid tale of my indiscretions or routine mention of me as counsell for a defendant, it makes no difference which, I am never contacted ahead of time by true diligent jimmy Olsen who authors the piece. Not that I would ofer much of a response, it is not only unwise but unethical to offer opinions to the media in regard to pending criminal charges.
I will say this, I did suffer a 90 day suspension of my law license as a consequence of my substance abuse problem and an arrest in early spring of 2013 for being under the influence of a controlled substance. I have been in outpatient treatment since and continue to trudge along the path of life.
As for the coward who thinks I should be disbarred for good, he is entitled to his opinion however ill informed. Rather than hide behind your social media cover I would encourage you to contact me and allow me the chance to explain why I think I do far more good than harm as a practicing attorney primarily in Inyo county. If you prefer to hide and take pot shots so be it
Amazing that it’s been two years and still no trial. They seem to have one story after another. Can’t wait for the extension next month and the reason behind it.
Just curious, does the suspension of Gerard Harvey have anything to do with the 2010 charges against him that were dismissed? Or is this something new?

Johnny, you seem to forget that our last DA was the real embarrassment to our legal system. At least Harvey cares about the people he represents!
I think the real story here is the 90 day suspension of Harvey. This guy is an embarassment to the profession. When will the good attorneys in Bishop file to have this man disbarred forever?

I have a idea,,, why don’t the two of you quit wasting the taxpayers money, plead guilty and start your prison sentences because that’s where you are going to end up…
Yeah, that’s most cops dream. Just make sloppy arrests with shoddy evidence and have the suspect plead guilty. Were you on the OJ murder case Roy?
Pedro,, I spent 10 years investigating major fraud cases, many that had losses in the millions of dollars. In darn near every case the paper trail of evidence is overwhelming. I never once had a suspect that could explain their massive spending habits, tens of thousands of dollars in banks, expensive cars, jewelry , trips etc. when they had a income of maybe 40-50k and absolutely no other reason to explain how they acquired the money.. Bank record search warrants are a great tool…. And no I did not work the OJ case but he was guilty as hell.
