Fugitive, Allen Stone Arrested
Shortly after 11:00am today, fugitive Allen Harlan Stone, a 24 year old Bishop man was arrested without incident in Bishop. The Inyo County Sheriff’s Office has been actively looking for Stone since receiving notification that he had brandished a fire arm on December 27th, 2013. Stone has two felony warrants for his arrest.
On Monday January 27th, the Inyo County Sheriff’s Dispatch received a report that Stone was causing a disturbance outside a residence in Bishop. The reporting party said that Stone had a butcher knife and was threatening the occupant of the residence. It was later determined that this person was not injured; however this prompted an immediate response from law enforcement which resulted in a vehicle pursuit. The vehicle pursuit began near the Rocking W area, and eventually ended in a driveway behind a residence in the 800 block of Winnuba Lane in Bishop. Both suspects fled on foot. The driver, David Martinez, a 34 year old man from Bishop was taken into custody.
Based upon Stone’s potential for violence, the Inyo County Sheriff’s Office requested assistance from the US Marshalls Fugitive Task Force. The US Marshalls Fugitive Task Force was able to provide technical assistance as well as additional surveillance.
Today the team narrowed down Stone’s whereabouts to a residence on the 500 block of North Pa Ha Lane where he was successfully apprehended. Upon his arrest, a strong odor of marijuana was detected within the residence. At this time agents are applying for a search warrant through the Inyo County Superior Court to look for narcotics. Also arrested at the residence was Emmett James Davis III, a 21 year old Bishop man with misdemeanor warrants.

the painful truth is that pedro is exactly right. while it may have been reasonable for the extra back-up if there was a potential for violence, everything that transpired after stone was taken into custody was unreasonable unconstitutional unethical and unlawful.
What specifically was all of the above? And, according to what source?

successfully apprehended? he surrendered himself before LE got to the door. it was alleged stone is violent and dangerous but records show he has never hurt anyone. he was taken into custody at 11am. the 25+ LEO remained on the property until 3pm. i suggest all of you request a copy of that warrent because the one that LE produced was for a trailer or RV, neither of which are located on the property or even the neibors property. not only did LE conduct a search and seizure for marijuana oder they did it with a warrent for a different residence. i wonder how much that cost the county?
Excuse me all you people!! You don’t know any of these men unlike me!! All anybody ever does is judge!!! Allen, yeah he’s the best brother anyone could ask for!!! Just because he’s violent doesn’t make him bad!!! We just lost our dad so shut up and you only know what you hear!! With isn’t always true !! I’m sure if it was your family/friend that was in this predicament you would help them out!!! You guys need to not judge a book by its cover, because everybody does have good in them!!!

for all you defending “medical card” smokers …… The reservation is federal grounds, so the medical card is invalid.. also, lets see if the house gets taken away from the person due to drugs, they have taken other peoples home for the same thing. or is this a case of “who you are and who you know”
Funny how state penalties apply on reservations, but not state protections.

So LEOs can get a warrant to enter someone’s house solely on the smell of Marijuana? We truly do live in a police state

Easy preventative measure: don’t let your house smell of pot.
It’s kind of funny, this time next year the cops may have to protect the rights of the pot smokers from the likes of themselves.
If we were in an actual police state there wouldn’t be a warrant requirement in the first place. If the occupants of the house had doctor’s recommendations for weed, then there wouldn’t be a need for the warrant. Not everyone is out to take away your pot or your rights. After the case has been adjudicated, go get a copy of the warrant when it’s public record and actually read it. Maybe then you can learn a thing or two about probable cause before you make assumptions.
Shame on the people who harbored Stone since the December 27th incident. He was reported as being violent and dangerous. He again became violent one month later and evaded yet someone still took him in. Everyone is lucky he didnt hurt anyone. I dont understand why this type of behavior is acceptable and overlooked by folks in the community. Did everyone already forget the murders that took place on the Reservation a few years back ???

Read the story sugar. He was arrested for brandishing a weapon and warrants, not because the house he was in stunk. The other guy was also arrested for warrants. The smell will lead to other things.
I think you need to re-read the article and my comment. I have no problem with the arrest of either party…I have a problem with a search warrant request based only on the smell of marijuana.

Stone sounds like bad news….thanks for getting him LEO. But what’s up with investigating the smell of marijuana? People can legally have marijuana in their house, so that should not be probable cause for a search.
If you think someone is dealing, catch them doing it…
…depends on how much you got,don’t you think ?….I guess this is going to be ANOTHER one of those stories with people posting and defending them…not so much for the violent crimes they (allegedly) committed (even though marijuana users never commit violent crimes,right ?),but for the simple fact that Law Enforcement ,again,was way out of line by entering the residence,to capture the (alleged) violent fugitives,and then obtain a search warrant to look into the possible dope dealing going on there…..maybe what LE should have done,once they smelt weed,is unhook the cuffs,throw up their arms,apologize,and gone on to their next call….
Cops are our of line getting a warrant over smelling pot.
