Senator Marie Alvarado-Gil to Hold Press Gaggle Following Assembly Public Safety Committee Hearing on Senate Bill 268: Violent Felonies – Rape
SACRAMENTO – Senator Alvarado-Gil (D-Jackson) will address the media outside Capitol Room 126 immediately following the Assembly Public Safety Committee hearing on Senate Bill (SB) 268. The Senator will be available for questions and will explain to media representatives why the bill will bring about crucial and long overdue legislative change.
SB 268 would classify the rape of an intoxicated person as a violent felony if the defendant caused the intoxication of the victim in order to assault them. This bill would ensure all victims of sexual assault receive equal protection under the law and that perpetrators who exploit a victim’s incapacitation face legal consequences to the fullest extent.
Under current California law, rape is classified as a violent felony only when committed against a person’s will by means of force, violence, duress, menace, or fear. This classification does not extend to cases where the victim is unable to give consent due to intoxication, unconsciousness, or disability.
