First, remember, it wasn’t that long ago at the Wye Road Shell station self defense was used in a life threatening situation. It was January 6, 2020. A local was held at gun point. How would AB 1333 affect an incident like this one? Full article here about the Wye Road Shell Incident Click Here.
What we found?
Assembly Bill 1333, introduced by California Assembly Member Rick Chavez Zbur in February 2025, proposes significant amendments to the state’s self-defense laws. The bill seeks to eliminate certain circumstances under which homicide is considered justifiable, notably in defense of one’s habitation or property. Additionally, it aims to clarify situations where homicide would not be justifiable, such as when an individual uses more force than necessary to defend against a perceived threat or when the danger could have been safely avoided by retreating.(Cite: LegalScan.com)
The introduction of AB 1333 has sparked considerable debate. Critics argue that the bill undermines the rights of individuals to protect themselves and their property, potentially favoring criminal elements. In response to the backlash, Assembly Member Zbur clarified that the bill’s intent is to prevent individuals from provoking violence and subsequently claiming self-defense, citing cases like that of Kyle Rittenhouse. He has pledged to amend the bill to ensure it does not impede a crime victim’s right to defend themselves, their family, or their home. (Cite: CaliforniaGlobe.com)
As of late February 2025, AB 1333 is under review and has not yet been assigned to a committee for further consideration. (Cite: San.com)
“This legislation builds on California’s gun safety legacy and lays the blueprint for the rest of the nation,” Monisha Henley, senior vice president for government affairs at Everytown for Gun Safety. “White supremacists and other extremists have hidden behind self-defense laws to fire a gun and turn any conflict into a death sentence. Now, lawmakers have an opportunity to help stop that and save lives. We thank Assemblymember Zbur for his commitment to gun safety and listening to advocates and experts on ways to keep Californians safe from gun violence.” (Cite: EveryTown.org)
Key points about AB 1333 and PORAC’s stance:
Restriction on self-defense:
The main criticism against AB 1333 is that it would make it harder to claim justifiable homicide in self-defense scenarios, even when defending one’s home, potentially forcing individuals to retreat before using lethal force.
Concerns about unintended consequences:
PORAC argues that the bill could discourage people from defending themselves against violent attackers, potentially putting innocent lives at risk.

If you cite Kyle Rittenhouse as a reason for stricter gun control, you haven’t fully examined the details of his case and are likely not basing your argument on accurate facts.
