I keep going be to the thought of maybe we should add the city of Los Angeles into this suit. Isn’t DWP really owned and run by the city? LA basically used fraud to get the land in first place.

The idea of Inyo County to acquire the landfills through the condemnation process was a brilliant bold move by the BoS . I was the right thing to do then and the right thing to follow up on now. Thank you Mags for the informative post.
Not understanding this. Yes, an env. document is required in order to use eminent domain, however, the document can be a CE if the project is just to acquire real estate. Since the county can adopt their own Resolution of Necessity, a requirement in order to attempt to condemn property under the power of eminent domain, nothing should be stopping the county from moving forward with the condemnation action. Other agencies successfully condemn LADWP property frequently.
I certainly hope they move forward with whatever action they need to in order to acquire these properties. Whatever happened with LADWP being a good community member? With massive land ownership comes much responsibility. Step up LADWP, the county should not have to condemn this land. They can agree to sell it under the threat of eminent domain and save the hassle of a condemnation lawsuit.
Well, I don’t think that you are an attorney or a judge because Inyo took a chance and they lost. Now Inyo County, already strapped for cash to pay regular bills is now on the hook for a huge bill. But you live in Mono County, so this won’t impact you. As for LADWP, they bought and own the land. Who wants a Landfill on their land, especially one that is unlined and leaking toxic crap into the groundwater.
