A Mono County Personnel Appeals Board upheld the termination of former Mono County mechanic Dick Luman, and now Luman has gone to Court for reinstatement of his job and all back pay and benefits.
Luman’s attorney, Katie Bellomo filed a petition for an administrative writ. This filing names the Mono County Personnel Appeals Board, Mono County, Administrator Jim Arkens, the Mono Board of Supervisors and others. The petition alleges that disciplinary action against Luman was based on policies not in effect until ten days after he allegedly got into a fight with one of his supervisors. Luman says the supervisor assaulted him. That was a year ago.
The Appeals Board found Luman had not engaged in physical fighting, but they claimed he verbally threatened his supervisor. The petition accuses the County and others of “prejudicial abuse of discretion” and failure to grant Luman a fair hearing. Attorney Bellomo also alleges conflicts of interest among appeal board members.
The document basically says the appeals board upheld Luman’s firing because he made a wisecrack to his supervisor, Brett McCurry, who was initially fire and then reinstated. The petition says Luman lost wages, benefits, retirement contributions and the right to public employment.
The petition asks that Luman be reinstated with all pay, benefits, seniority and other considerations.

Mr. Luman was terminated for instigating a fight….but guess what? He didn’t and so the panel found some minor issue to be the basis to sustain the termination by determining some remark was a threat. I have read worse on POSTS.
And then you consider Mr. Obenberger being a party to the initial investigation that should be described as “creative” at best. Obenberger rather than recuse himself stayed on the panel. Why? Somebody wanted Luman gone…..and then they have the odacity to reinstate the actual instigator of a fight!
Please let some wise person step up and make everythig right by doing the right thing.

This is good news. Based on previous accounts Mr. Luman seems to have been deprived of his rights during the administrative hearings. This is not so much the ‘doing’ of Bridgeport as the prevention of legal tricks in the administrative hearing (non-court) process.
These Government entities just don’t get it. They think they are above it all and can do what they want. Well I hope they get their heads handed to them on a silver platter.

Someone needs to read their constitution. Portions of states can’t simply be “annexed”. Though I wish they could so the Owens Valley could get out of the sunken ship that is California.

Including moving one county seat to another area to keep up with economic reality.

There are Californians who became educated, got good jobs, watched their spending, etc., who are doing quite well today.
Then there are those who were not paying attention to what the “New Norm” is today and are mad at the world.
I just wanted to say that I am proud that there are a few people in this county willing to stand up for themselves. This county operates unfairly and on the good ole boy system. McCurry was the aggressor in this fight and he got a slap on the hand because he performed how Mono County promotes their supervisors to act. Through intimidation, harassment and by using bullying tactics. We all knew and predicted McCurry would get his job back. This county is underhanded and think they can treat their employees anyway they please. This is going to come to an end,,,, mark my words. There are a few strong proud people that are making that happen one step at a time.
